Order and contract conclusion

1.The offer of the products in the eshop www.spikes-spider.ch does not yet constitute a binding offer by the seller.

2. By clicking the "Add to shopping cart" button, the selected items are placed in the shopping cart. In the final step "to checkout", the ordering process begins, whereby all the data required for processing the order(s), are recorded.

At the end of the ordering process, a summary of the order and contract data appears. By clicking on the "Buy" button and ticking the box in front of the notice, "I have read the terms and conditions of your shop and I agree to their validity", the order is confirmed and binding.

3. A contract is only concluded with a written or electronic order confirmation by the seller. The seller is entitled to accept the customer's contract offer within 3 working days after receipt of the order.

Storage of the contract text

The text of the confirmed order between the seller and the buyer is saved and accessible to the customer (=buyer).

Right to withdraw/return

Buyers have a fourteen-day right to withdraw/return. The buyer bears all costs of the return. The details of your withdrawal/return rights can be found in our cancellation policy in the terms and conditions.

Warranty law

The buyer has a statutory warranty right. You can find deviating regulations in our terms and conditions of purchase.

Payment options

You can choose to pay in advance (bank transfer) or by PayPal.

If you choose to pay in advance, our bank details will be provided in our e-mail order confirmation. The goods will be delivered after receipt of payment. If you pay by PayPal, your account will be debited upon completion of the order. There are no additional costs for these payment options.

Shipping

The buyer bears all shipping costs for his order. Our prices include packaging that is customary in the trade and suitable for normal shipping. The current shipping prices are shown in the online shop.

Deliveries made within Switzerland and the Principality of Lichtenstein are invoiced in CHF. All deliveries to Europe are invoiced in Euros.

The delivery times within Switzerland are between 2-5 days after receipt of payment, delivery times to Europe are between 3-6 days after receipt of payment.

Complaint management

Any queries regarding the goods (for example availability, invoice, receipt of payment, etc.), contact the seller, stating your order number, which can be found in our e-mail order confirmation.

Terms and conditions of purchase

1. Basis of the contract

All contracts that the buyer concludes with the seller are based exclusively on these terms and conditions of purchase. The buyer expressly recognizes this with his order.

2. Terms of delivery

Deliveries are made within Switzerland and the Principality of Lichtenstein and to Europe.

Delivery deadlines are only binding if they have been confirmed by us. If an article in our range is exceptionally unavailable, the customer will be informed as soon as possible by e-mail.

Deliveries from Rheineck are made by DHL, DPD, and other forwarding agencies. The buyer bears all shipping costs for all orders.

3. Prices

The prices stated on the product pages are in Swiss francs for Swiss customers and in euros for customers from Europe, each including the statutory VAT.

4. Obligation to inspect

Customers are asked to check all deliveries for correctness, completeness, and defects immediately upon receipt. Any errors or defects must be reported to the seller immediately. The goods must be returned in their original packaging, unused and complete.

5. Warranty

For 2 years after delivery, the seller assumes the statutory guarantee that the ordered product is free from defects and is functional. The seller can provide the guarantee either through a free repair or a replacement with an equivalent product.

6. Right of withdrawal

The buyer has the right to revoke his contract within 14 days, by giving written notice,(letter, fax, or e-mail) or by returning the item.
The period begins upon receipt of this written notice.

Personalized products are excluded from the right of withdrawal
The return of the product takes place at the expense and risk of the buyer. Returned damaged products will not be accepted.

7. Liability and Disclaimer

Liability is based on the applicable statutory provisions.

However, the seller is not liable in the event of any of the following:

• Negligence by not following the operating instructions
• Direct and indirect damage and consequential damage and lost profit
• Damage from delay in delivery
• Any acts and omissions of the seller's auxiliary persons, be it contractual or non-contractual

8. Retention of title

The goods remain the property of the seller until they have been paid for in full.

9. Data protection

We would like to point out that we trea our customers' data in the context of normal business transactions in accordance with the Data Protection Act. Except when your online payment is recorded by the payment provider, no data is passed on to third parties. You can find additional information in our data protection declaration.

10. Intellectual property

The name Spikes-Spider is internationally protected under trademark law. The seller reserves all rights for every photo, design and text on the website. Copying or any other reproduction of the content of this website is illegal.

11. Applicable law/place of jurisdiction

These terms and conditions of purchase and the contracts concluded on the basis of these terms and conditions are subject to Swiss law in accordance with the OR and the ZGB.
